Divorce and Estate Planning

Married individuals who are separated and in the process of divorce, must review their estate plans to determine if their goals, in the event of death or serious illness, are in keeping with their last wishes.

In the event you were to die or become disabled prior to the entry of the final divorce decree, your spouse may have legal control over you, in the event of illness, and will receive a portion, if not all, of your estate in the event of your death.

It is critical for you to re-draft your Last Will and Testament as well as any trusts that may be modifiable. Certainly, in the event of your incapacity, appropriate documents can be entered into, prior to the entry of a final divorce decree, which will make certain that the individual you wish to have control is properly designated.
